Chapter 7 and Chapter 13 Bankruptcy

Chapter 7 bankruptcy is sometimes referred to as “liquidation” bankruptcy, because it involves the dissolution of the debtor’s non-exempt assets to pay off their debts. Chapter 7 bankruptcy is often a good option for people with little or no disposable income, as it can provide a fresh start by wiping out most of their unsecured debts. If you have mostly credit card debt, medical bills and unsecured loans, this may be the best option for you.

On the other hand, Chapter 13 bankruptcy is sometimes referred to as a “reorganization” bankruptcy, because it involves the reorganization of debts and the creation of a repayment plan. Chapter 13 bankruptcy is beneficial for people with steady income who want to keep their assets, such as a home or car, but need help managing their debt or who just need time to catch up on payments on their mortgage or other secured debt.  A Chapter 13 can stop the foreclosure sale of your home and protect all assets for up to 5 years.

Despite these differences, every situation is unique, and the decision to file for bankruptcy should be made with the help of an experienced bankruptcy attorney.
